Member's Terms of Service

General

By signing up and using the CashChute, LLC, (hereafter "CashChute") program you agree to all terms and conditions set forth in this agreement and those of the entities making offers within our program. CashChute may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. If any modification is unacceptable to you, your only recourse is to terminate this agreement and not participate in this program. Your continued participation in the CashChute program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

All information provided by you to CashChute must be complete and 100% accurate when registering and must be updated in a timely manner if it becomes outdated. All addresses must be in the United States. Users residing outside the U.S. will not have items shipped to them and will not receive credit for completing an offer. The current home address of the user must be entered for their street address. Post Office boxes, work addresses, or other alternate addresses may not be used.

CashChute may place a hold on your account and not deliver any prizes for any activity in violation hereof or which is contrary to the terms and conditions of any particular promotion or offer. Further, we reserve the right to file charges for recovery of any earnings received from any activity in violation hereof or the terms of the particular promotion. Among the activities which represent grounds for an account hold are:

▸ Multiple signups for a particular offer, through this program or any other similar program

▸ Signing up for the same offer multiple times from the same computer or ip address

▸ Using AOL to connect to the internet. AOL users have the same IP and will get your account placed on hold.

▸ Having more than one account on the same ip address or using the same house address. Also using another member's ip address to do an offer can get your account put on hold

▸ Providing any false information to CashChute or refusing to provide any relevant information

▸ Cancelling a subscription offered under our program under conditions suggesting a lack of intent to honestly and fairly evaluate the service or product

▸ Failing to honor any term or condition of any offer

▸ Participating in any offer utilizing a pre-paid or gift card, unless same is specifically authorized.

Once your account is on hold as above anticipated, CashChute is under no obligation to release the hold, or any prizes earned on that account.

CashChute makes no guarantee that the description or requirement of an offer is valid, however all descriptions and requirements are added with good intentions of being correct. It is your responsibility to read the Terms and Conditions on every offer.

Relationship of the Parties

The relationship between You and CashChute is merely as independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and CashChute. You understand that you do not have authority to make or accept any offers or make any representations on behalf of CashChute. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the CashChute program. For privacy and for protection of our marketing strategies no part of the site, emails, newsletters, updates, templates and promotions may be reproduced in any way without prior consent. This includes, but it not limited to, use of our images, ideas, text, terms or any other information we consider as proprietary or copyrighted material.

Publishing/posting/quoting part or all of such content online or offline by any means or method is prohibited.

Waiver of Warranty/Limitation of Liability

CashChute will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement, the CashChute program, or any offers found in the website of CashChute, even if CashChute has been advised of the possibility of such damages. Furthermore, CashChute's aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. CashChute makes no warranty as to the legitimacy of any offer or advertisement or that the advertiser will make payment to CashChute for your lead.

Spam

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with CashChute and may result in legal prosecution. CashChute will make reasonable efforts to comply with anti-spamming laws. Spamming is a federal crime. Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for spamming as we intend to cooperate with any authorities and investigations that may arise from the Spamming incident. CashChute may charge up to $5 per Spam email sent.

Prize Redemption

CashChute will make reasonable efforts to provide earned and designated gifts in a timely manner after CashChute has received confirmation of approval by the customer of CashChute and compensation from advertiser. If a selected gift is not available, another gift of equal value may be substituted and, in any event, a prepaid card of substantially equal value of a chosen gift will be deemed acceptable. CashChute reserves the right to change the point value for any prize due to price changes in the market. Identification may be required in order to have your account verified and prize shipped. Anyone who refuses to provide identity if asked will have their account placed on hold until identity is verified. CashChute is under no obligation to send out prizes if CashChute is not paid, if payments for leads are actually reversed or if CashChute has a good faith concern that an advertiser may deny the payment on the offer or lead for any reason. CashChute may also deny payment if your account is inactive. Your account will be marked as inactive if you have not logged in within the last 30 days.

By registering and through continuing use of CashChute you are asserting your agreement to the Terms of Service stated. The parties agree that this agreement is to be interpreted according to the laws of the State of Texas and the sole venue location will be Ector County, Texas.
